A man from Green convicted last month of assaulting his girlfriend and several other charges was sentenced this morning in Douglas County Circuit Court to serve over three years in prison.
Thomas William Baraby, 25, pleaded guilty Feb. 14 to felony charges of fourth-degree assault and felon in possession of a firearm.
He entered the pleas before his trial was set to begin that day on attempted murder, attempted first-degree assault and misdemeanor second-degree child neglect charges stemming from the domestic dispute last September in which Baraby was accused of firing a gun at his girlfriend.
Judge George Ambrosini found the man not guilty of the two most serious offenses, but did find him guilty of the child neglect charge.
Baraby had also pleaded guilty to misdemeanor charges of endangering the welfare of a minor, providing false information to police and resisting arrest.
Ambrosini sentenced the man to 18 months in prison for the assault conviction and 22 months for felon in possession of a firearm. Those charges will run consecutively, which means Baraby will spend 40 months in prison.
The judge also sentenced the man to one year for each misdemeanor charge, but those will run concurrently each other and the felony charges.
Baraby, Ambrosini ruled, will not be eligible for prison programs that could have allowed him to be released earlier.
